The density of population in urban areas such as Jabodetabek makes the
government hold public transportation facilities to reduce the number of
congestion that occurs every day. One of them is the KRL Commuter Line,
because the cost is cheap, fast, and convenient. Therefore, KRL Commuter
Line is never empty of passengers, especially in the morning and after work.
The crowd is used by unscrupulous people to commit sexual harassment.
Taking for example a sexual harassment case that occurred on October 24,
2022, in the morning on the Bekasi – Kampung Bandan KRL route, sexual
harassment occurred where in the victim's statement, the perpetrator committed
harassment by attaching a penis to the victim's buttocks and deliberately
holding the victim's breasts. The research aims to understand legal protection
for victims of sexual harassment and what steps or actions the service provider
takes, namely PT. KAI and PT. KAI Commuter Line in providing its
responsibilities and legal protection for passengers who are victims of sexual
harassment. Research writing uses normative juridical methods where
approaches are based on laws and regulations. The data in this study is based
on secondary data such as journals, articles, and other supporting data. Sexual
harassment is regulated in Law 2022 on Sexual Violence No. 12 of 2022 as
well as in Articles 281 to 303 of the Criminal Code. As well as KAI's
responsibility as a service provider must compensate by providing
compensation, which is stipulated in several articles in the Consumer
Protection Law No.8 of 1999. |
