LAW ENFORCEMENT CRIMINAL ACTION OF HATE SPEECH IN SOCIAL MEDIA RELATED TO CRIMINAL SANCTIONS ON LAW NUMBER 19 YEAR 2016 RELATED TO REVISED LAW NUMBER 11 YEAR 2008

Abstract

The research has a purpose to analyze and find anwer for two thing, thre are: first, legal arrangements related to hate speech in social media. Second, law enforcement of the perpetrators and criminal sanctions after the revision of Law no. Law No. 11 Year 2008. This research done by normative legal research,this research examine the problem to find put the solutions using the methods which obtaining the remaining way which could controlled and has the basis of any kind of supporting theories related to hate speech. In this research writing, using data collection technic literature study,sample of case , approach of comparative and philosophy by using related constitutions and regulations, supporting by the theories and related to the research problem as the central focus,in addition author using comparative approach with Malaysia and Singapore Law to certain regulations which concern to the Hate Speech. The result of research that had already found: first, in hate speech there are some elements that are most abused or most often occur in social media conducted by a person, community group or institution such as insulting, defamation, hoax and unpleasant deeds. Second, a revision of hate speech penalty sanctions does not make a deterrent to a violation in social media.
