OMNIBUS LAW IN THE LEGISLATION SYSTEM OF REPUBLIC OF INDONESIA (LAW NO 11 OF 2020REGARDING JOB CREATION LAW)

Abstract

Indonesia is a country that use civil law legal system in its country. Many laws that are created are according to the constitution of the country, which is UUD 1945. Because of time-to-time experience. Our current President, President Joko Widodo in his re-election in 2019 make some new regulations. The one that well-known is the Omnibus Law. Omnibus law especially the job creation law, Law no 11 of 2020. A law that has so many pros and cons. In this Thesis, the writer wants to explain about the advantage and disadvantage of the omnibus law. The law- making process in Indonesia legislation system will be explained and the formation of this omnibus law in Indonesia legal system. The author used the normative legal research because studying law as an object of study of the aspects of the law do by looking at the development of concepts of existing law that essentially saw the object assessment norm of law is as a collection of positive norms in public life. The aim of law as object study is finding out the legal principles that should apply and should not apply sourced from their specific values. The author also uses some information of the Omnibus Law because it still a hot topic in Indonesia currently. The conclusion of this Thesis is the government should be more approachable and involving the region government, citizen and the businessman from the low and middle business.
