The rise of Artificial Intelligence (AI) has created profound impact in human life and reimagine our entire society. Intellectual property was one of the sectors that AI successfully transform. The rapid development of the present technology enabled AI to independently create creative works and invention without any human intervention. More than 340,000 AI-related applications have been received by the Intellectual Property office since AI first emerged. However, this create plethora of legal issues, namely on the ownership over the creation of creative works or invention without human intervention, its compliance over the prevailing copyright regulations in relation to the AI text and data mining process, and the sufficient degree of disclosure on the invention. This thesis desires to explore the legality of AI generated invention by evaluating the ownership rights and its liabilities. This thesis will utilize normative legal method to approach the existing issues. Consequently, this thesis will focus to analyze the legal norms contained within scientific writings, court decision and rules and regulations. Additionally, this thesis will utilize doctrinal approach by emphasizing on international journal and reports by relevant bodies. Hence, it is hoped that this thesis will provide significant insight towards the legality of AI as the uncertainty remains prevalent within the prevailing law and regulations. |
