THE COPYRIGHT LAW ENFORCEMENT ON THE UNAUTHORIZED MONETIZATION OF COVER-VERSION SONG ON YOUTUBE

Abstract

The advancement of technology in the creative industry is very rapid. Everyone can freely upload content on various digital platforms such as Youtube, Tiktok, Spotify, Instagram, etc. Many people upload cover versions of a song for entertainment or personal enjoyment purposes without the intention to monetize the content. However, it is not rare for cover-version songs to be monetized, even without authorization from the copyright holder, this is an activity that violates the law. Cover songs monetization that does not have permission from the creator or copyright holder, is a form of Copyright infringement. Therefore, the Creator or copyright holder, as a party whose rights have been violated, can take 2 legal steps, namely Litigation (Civil Lawsuits and/or criminal charges) and Non-Litigation (Arbitration and/or Alternative Dispute Resolution). The type of research conducted was the library research method which focuses on literature study. This research was conducted in order to obtain materials related to the subject in the form of theories, concepts, legal principles, and legal regulations.
