NUSYUZ DAN IMPLEMENTASI HUKUMNYA (STUDI PERBANDINGAN HUKUM ANTARA INDONESIA DAN MALAYSIA)

Abstract

This thesis reveals research on the implementation of nushuz based on Indonesian law and Malaysian law. By looking at the terms of Al.Qur, School and rule of law from each country. Data collection methods used consisted of Content Analysis and Comparative Law by tracing aspects of the laws and regulations between the State of Indonesia and Malaysia. The results of the research show well in Law No. 1 of 1974 and the Compilation of Islamic Law (KHI) did not discuss at all the nusyuz which is different from the Federal Islamic Family Law of 1987 which contains the right of granting nushuz given to men. This is expected to be a reference or reference source for the Government of Indonesia to pay more attention to gender between men and women.
