Abstract

In Indonesia there is an agency that is authorized to oversee foreigners and citizens of Indonesia who want to come out or who want to enter the territory of Indonesia. The agency is Immigration. Immigration is one of the most important part of the tasks and responsibilities that are very determining the existence and strength of the country concerned. Anyone who comes in and out of the territory of Indonesia must first deal with the immigration authorities. There are often some problems of immigration clearance and has grown into a big problem because of the negligence of the immigration authorities or by deliberate intention by the person concerned because they do not want to extend their immigration permit. Therefore, it requires the enforcement of criminal law against the misuse of immigration clearance. The aim is to maintain the sovereignty of the state this is due to the presence of foreign nationals who do not misuse a permit of immigration. Even the intention to commit the offense already exists while still in his country. In Article 105 of Law Number 06 Year 2011 on Immigration, states that the Immigration Civil Service Investigator (PPNS) Immigration is authorized as an Immigration criminal investigator conducted in accordance with the provisions of this Law.
