THE IMPLEMENTATION OF SUPERVISION TO LIMITED LIABILITY COMPANY (PT) TOWARDS A MISUSE OF BUSINESS LICENSE ON PT JOUSKA FINANSIAL INDONESIA

Abstract

Limited Liability Company is a business entity whose being increasingly maximized in existence. The issuance of regulations on Limited Liability Companies as genuine evidence that the government of the Republic of Indonesia is willing and responsible by the provisions provided. Limited Liability Companies do not escape their negligence. A legal entity needs a legal subject to manage its own organizational activities, this way the establishment of the Limited Liability Company is based on a legal process is established based on a legal process and is carried out according to the legal rules as stated in Law No. 40 of 2007 concerning Limited Liability Company. By looking back at the provisions of the regulation was promulgated in this research is intended to recognize the basic legal provisions concerning the establishment and business licensing of Limited Liability Company and the extent of the supervisory role in managing the company by understanding the description in legal cases of the misuse of business license in the financial services sector, using the juridical-normative research method with the type of legal approach on the Statue Approach and the Conceptual Approach with primary and secondary legal materials. Thus, the results of this research define that the supervisory regulations and the role of the government in the supervision of the company have been well-designed with the provisions of the Law of the Republic of Indonesia.
