THE OVERLAP OF INDONESIA’S MAINTENANCE OF GOOD ORDER AT SEA IN RESPONSE TO IUU FISHING ACTIVITIES IN THE SULAWESI SEA (2014-2018)

Abstract

The Sulawesi Sea is a strategic region with tremendous fishing resources. It supports the livelihood of the people in the region with the Bitung City dominant in the fisheries sector. Indonesia’s Maritime Security Policies related to the combat of IUU Fishing such as the moratorium on ex-foreign fishing vessels and the ban of transshipment has disrupted the region’s economy. This policy has been effective in preserving the fish stock in the region. However, in terms of combatting the factors that contribute to the conduct of IUU Fishing, especially in the flaws of law enforcement, this is not the case. This thesis uses Booth’s Constabulary Function to explain the navy that contributes to the MLEAs through its coastguard responsibilities. The MLEAs and the Constabulary Function will then result in the multiple agency structure. It can be seen in the multiple agency structure that the spectrum of law enforcement in the region consists of overlapping tendencies. The thesis then tries to assess if Indonesia has fulfilled Till’s ocean management requirement in terms of combatting IUU Fishing in the Sulawesi Sea. The results are that Indonesia mostly lacks coordination in the operational level because in the strategic level exists no mechanisms to coordinate the authorized agencies. In terms of the tactical level, Indonesia still lacks the proper and high technology to overcome the modus operandi by perpetrators of IUU Fishing. However, the first Jokowi Administration has embraced the grand strategic level by campaigning war on IUU Fishing with transparency and the sinking vessel policy.
