Abstract:
The discrepancies between procedures and their implementation in the field
regarding Building Permits (PBG) for the Indian Embassy. Therefore, formulates
an issue regarding the application of the Principles of Good Governance (AUPB)
in the issuance of the PBG for the Indian Embassy, as well as the legal implications
of the PBG issuance in Decision No. 455/B/2024/PT.TUN.JKT, using a normative
and qualitative legal approach as the analytical method. The results indicate that the
DKI Jakarta DPMPTSP violated the principles of AUPB under Law No. 30 of 2014
on Administrative Governance, there was no evidence of payment of fees, and it
also violated Law No. 3 of 2022 on the IKN. Judgment No.
455/B/2024/PT.TUN.JKT upholds Judgment No. 93/G/2024/PTUN.JKT, which
annulled the issuance of the PBG for the Indian Embassy. However, the judgment
does not address the maladministration that occurred during the issuance process.
