Abstract:
Concert ticket fraud, particularly through scalpers, has become a significant issue
in Indonesia's entertainment industry. With the shift to online platforms for ticket
sales, fans face the risk of obtaining counterfeit or non-existent tickets from
unauthorized sellers. This study examines the legal validity of transactions
involving the purchase of electronic concert tickets from scalpers by reviewing the
Indonesian Criminal Code (KUHP) and the Law on Electronic Information and
Transactions (ITE Law). The research questions focus on whether such
transactions are legally valid and the way legal provisions apply in cases of fraud
involving scalpers. Using a normative legal research method, this study analyzes
relevant laws, regulations, and court decisions, with particular emphasis on the
case of Sheila On 7 concert ticket fraud. The findings indicate that, although ticket
scalping is not explicitly classified as illegal under Indonesian law, fraudulent
activities such as the sale of counterfeit tickets or misrepresentation of ticket
availability are considered criminal offenses and are subject to legal penalties.
