Abstract:
Advocate is an honorable profession (officium nobile) which in performing his profession is under legal protection, legislation and codes of ethics. Currently the prevailing code of advocate professional ethics in Indonesia is the Code of Indonesian Advocate Ethics. Code of Indonesian Advocate Ethics is the highest law in carrying out advocate profession, which is to guarantee and protect, but also imposes a duty on every Advocate to be honest and responsible in their profession as well to clients, the courts, the State or society and especially to himself. The enforcement of Code of Indonesian Advocate Ethics is performed by the Perhimpunan Advokat Indonesia (PERADI) as a single container of Advocates (Advocate Organization) recognized in Indonesia. The enforcement is conducted in two stages which are supervision by the Supervisory Commission and action (examining and adjudicating) by the Board of Honor. Thus, the action function implemented by the Board of Honor is a very important stage in enforcing the code of advocate ethics. Unfortunately, violations of the Code of Indonesian Advocate Ethics are still found especially in DKI Jakarta area. This research aims to discuss how the enforcement of the Code of Indonesian Advocate Ethics is being implemented by the PERADI Board of Honor of DKI Jakarta and what steps need to be done to improve the effectiveness of the Board of Honor’s performance. This research is a socio-legal study using statutory approach and social approach.
