Abstract:
The presence of legal technology start-ups has a big influence in the legal industry, including in providing legal services such as legal consulting. Legal technology has made legal services faster, cheaper, more efficient, and more accessible to people who need legal services. In Indonesia, there are several technology start-ups that provide products and services in the legal industry. Legal technology startups offer advice on legal or legality issues facing clients. Now people can use digital-based legal services such as legal consultation with legal experts or advocates via telephone or online chat offered by legal technology start-ups. However, the presence of start-ups in the field of digital-based legal services is still not supported by the regulations governing it in Indonesia. Including how the regulations governing lawyers and non-advocates in providing legal services through legal tech start-ups. An advocates who provide legal services are subject to Law Number 18 of 2003 concerning Advocates and the Indonesian Advocate Code of Ethics. However, the Laws and Regulations do not state what platforms can be used by advocates and non-advocates to provide legal services. Therefore, more specific regulations are needed for the presence of legal tech start-ups in Indonesia and advocates who provide legal consultations through legal tech start-ups. An advocate can provide legal advice to clients through legal technology start-ups, as long as its implementation in providing legal consulting services does not violate the law or violate an advocate's code of ethics. Non-advocates who provide legal consultations can only provide consultation with the extent of general knowledge about the law because non-advocates cannot be subject to the sanctions contained in the Advocate Code of Ethics and Law Number 18 of 2003. Therefore, an ideal arrangement for legal consultation through legal tech start-ups in Indonesia is needed.
